Administrative Action

If you have been served papers for ‘Administrative Action’, be it ‘Minor’ or ‘Major’,  Jonathan Lynch can provide you with advice and assistance throughout the process.  The process is, however, designed to be simple enough for service personnel to respond to the allegations without the assistance of a lawyer, so contact Jonathan Lynch to discuss whether or not you need to instruct a lawyer in the first place.

Unacceptable Sexual Behaviour

2022DIN01-035 ‘Zero Tolerance to Sexual Offences and Sexual Relationships Between Instructors and Trainees’ brought in a new worry for members of the UK Armed Forces. Whilst there is clearly a need for unacceptable sexual behaviour to be stamped out of the UK Armed Forces, there is a wide spectrum of behaviour and, in the early stages of this policy, it appears that some Originating Officers need assistance in understanding where on that spectrum we need to draw the line. Unfortunately, there are also those who abuse the process with malicious intent. Jonathan Lynch can help you respond to such allegations and, in doing so, assist the Deciding Officer in understanding what this policy is designed to achieve and how to properly apply the test of ’the balance of probabilities’ to the evidence collated by the Originating Officer. Jonathan Lynch can also assist you in obtaining witness and other evidence to support your position. 

This is a new process for everyone. Using relevant experience and an intimate understanding of the military mindset and way of life, Jonathan Lynch can help guide the entire process to a proper conclusion and, ultimately, achieve a more sensible approach by everyone to such matters in the future.
